Mountain Driving

 

This section is included as an addendum to the Terms of Service.  Please read carefully before your mountain excursion

 

Winter and Mountain Driving

Colorado winter and mountain driving pose unique risks, including snow, ice, steep grades, high winds, avalanches, road closures, and rapidly changing weather. As the renter and driver during the rental period, along with any approved drivers, you voluntarily assume all risks associated with winter and mountain driving. Additionally, you understand that:

  • Mountain and winter driving is inherently hazardous

  • Road conditions may change rapidly without warning

  • It is not uncommon for Interstate 70 and mountain passes to close due to weather or accidents

The Company does not control weather, road maintenance, or traffic conditions that cause delays, closures, or reroutes that are common during winter months and may incur unforeseen consequences in completing your travel plans.

  • Alternative routes may be required and may increase travel time

  • Travel delays or cancellations do not entitle the renter to refunds

  • 4x4 or AWD capability does not guarantee safety or traction.

  • Winter tires improve traction but do not eliminate risk

  • Driver skill and judgment are critical to safe operation. The presence of 4x4, AWD, or winter equipment does not reduce your responsibility.

 

Chain Laws, Traction Control, and Legal Responsibilities

  • Colorado traction laws are in effect from September 1st through May 31st. Company vehicles are equipped to properly meet or exceed Colorado requirements. Renters need to familiarize themselves with Colorado laws and requirements and comply with law enforcement in assessing the use of Company vehicles during the designated time frame. You are required to monitor current road conditions and closures. In the unforeseen event that law enforcement determines additional traction control is required beyond the use of All Wheel Drive, four-wheel drive, and adequate tires, you must obtain, carry, and properly install chains. Failure to comply may result in fines, towing, damage, or accidents for which you will be held liable.

  • Road Closures and Trip Interruptions

  • Renter acknowledges that road closures and trip interruptions are common from September 1st through May 31st. Adjusting travel during road closures does not waive any additional

expenses, and the Company is not liable for any costs arising from unforeseen delays, road closures, or other events that may alter the renter’s travel plans.

 

 

  • Prohibited Conduct in Winter Conditions The following are strictly prohibited:

  • Driving during declared road closures

  • Attempting travel in unsafe or restricted conditions

  • Disabling traction control or safety systems

  • Off-road or unmaintained road travel

  • Violation may void insurance coverage and result in full financial liability.

 

The Company does not guarantee: access to any destination, road passability, or the ability to reach ski resorts or mountain towns. Travel decisions remain the sole responsibility of the renter.
